FLORA’S commitment to Data Privacy and Protection

We are FLORA. A hygiene and cleaning products company, with a portfolio of 12 brands and around 195 products distributed all over Brazil.

If you use any of our sites or are a customer of any of the products offered by our brands, these Privacy Terms apply to you. We are committed to safeguarding your privacy and protecting your personal data, and this document aims to show you how we do that.

By using our sites, you agree to the use of your information as described in these Privacy Terms.

It’s important to note we collect your data so that we can provide you with our services in the most appropriate and efficient way. Precisely so that we can have trust as a basis for providing our services, we treat any data or information collected about you as confidential and will only use it for the purposes described in these Privacy Terms.

We have tried to make this policy as simple and accessible as possible, using examples to make it an enjoyable read and so that you can understand how we process your data. See the sections of these Terms below:

1. How and why FLORA collects your data

In order to provide our quality services, we may collect different types of data about you (collected through our websites and/or in connection with other activities that are part of our business operations). In order to be transparent, we have listed below some of the purposes for which we may process your personal data:

  • To identify you when you visit our website or contact us, in order for you to get the best service, such as registering and tracking the service provided to the consumer, for example, through the Customer Service Channel (SAC) or using the forms available on our site.
  • To develop and improve our products, services, methods of communication, functionality of our websites or to understand and evaluate the changing interests, wants and needs of consumers – or to tailor the content of our website to provide you with a more personalized experience and draw your attention to information about our products and services that may be of interest to you. For example, to enhance your experience when using this site and to ensure that it is working effectively, we (or our service providers) may use cookies (small text files stored in the user’s browser) and web beacons that may collect personal data. Additional information on how we use cookies and other tracking technologies, as well as how you can control them, can be found here.

  • To communicate information to you and to manage your registration and/or subscription to any newsletters or other communications.
  • For the purpose of contests or promotions that you have entered, or to manage our daily business needs related to your participation in our contests, sweepstakes or promotional activities.
  • To provide services and complete requested purchases (which may possibly include data on individuals) and thus the acceptance, processing your payments (including any refunds) and delivery – and to let you to know the progress of your order, address your questions and requests, and assess and deal with any complaints.
  • This is so that FLORA can have a record of your purchases, should you have any questions, complaints or concerns regarding your purchases. Or even so that FLORA can have information on file if required legally or in a court or administrative proceeding.
  • For information and quality assurance purposes, including recording or monitoring telephone calls made to customer service (SAC) in order to offer better service, perform quality controls, comply with current legislation and legal demands.
  • For recruitment and business development/operation purposes such as financial accounting, billing and risk analysis (DDI).
  • To protect our rights, complying with applicable legal or regulatory requirements and responding to requests and communications from competent authorities.
2. Collection of sensitive data and collection of data on minors

In some cases, we may collect some personal data considered sensitive as defined in the Brazilian General Data Protection Act (LGPD) (personal data about racial or ethnic origin, religious conviction, political opinion, membership in trade unions or religious, philosophical or political organizations, data concerning health or sex life, genetic or biometric data) or collect some personal data that might reveal sensitive data. In such cases, we will only process these data in accordance with any of the legal bases available in Article 11 of the Brazilian General Data Protection Act (LGPD).

Moreover, we understand the importance of protecting the privacy of children. Our site and our services are not designed for or intentionally targeted toward children. It is not our policy to knowingly collect or store information about children. Only individuals over the age of eighteen (18) are authorized to use the Shopping Channels offered by FLORA, consenting to this condition. By ACCEPTING these Terms, you indicate full and unquestionable understanding of this and all other sections of this document.

3. Who do we share your information with?

We do not sell or exchange your personal data with companies or individuals, but we do share it with Business Partners as an essential part of being able to provide our services to you. These Partners may be service providers, companies that operate credit and debit cards and/or related banks to process payments through Compra FLORA. We are all committed to keeping your information secure. FLORA may also share your personal data in order to comply with applicable laws, for tax and/or consumer purposes, and to cooperate with the competent authorities.

We may share non-personal, de-identified and aggregated information with third parties for various purposes, including data analysis, research, contributions, eminent content and promotional purposes.

Links to External Channels. Our site has links to other websites that have their own privacy and confidentiality policies. If you visit other sites, we recommend that you carefully read their privacy policies and practices as these Privacy Terms do not cover third-party policies and practices.

4. International Data Transfer

To supplement the “Who do we share your information with?” section, in some cases FLORA transfers personal data collected in Brazil to other countries that may be located outside the European Union and whose laws may not offer the same level of data protection. In such cases, we will ensure that there are adequate safeguards in place to protect your personal data in compliance with our legal obligations. This is the case, for example, of some IT & IS tools (such as Management Systems) we use that have servers in the United States.

5. Where do we store your personal data?

All personal data are stored on servers located in Brazil and in some cases in the United States. In the future, FLORA may relocate and store these servers in any other country that complies with privacy legislation, in order to have a backup, always keeping them under our supervision and secured.

6. How long do we keep your personal data?

We will only keep your personal data for as long as necessary for the purposes for which we collected it, including for the purpose of complying with any legal or contractual obligations, reporting or request from competent authorities.

7. How do we keep your personal data secure?

We protect your personal data against all types of threats: destruction, loss, alteration, unauthorized disclosure or access. FLORA protects your Personal Data in accordance with the security and confidentiality standards and procedures established under Brazilian legislation. When you register on the Shopping Service Channels on Digital Platforms (such as “Compra FLORA” and “FLORA Kit Subscription (PicPay Partnership)” by creating a specific access account (with a username and password), we advise the following:

Password Confidentiality. If you lose control over your account or password to access the Digital Platform, you may lose control over your personal data. Therefore, FLORA recommends that you keep your password strictly confidential, avoiding disclosing it to third parties. FLORA will never ask the User to inform his/her password by telephone, e-mail or any other means of communication. The User’s password must be used exclusively when accessing his/her account on the website. If you suspect that your password has been exposed to third parties or if your password may have been compromised for any reason, reset it immediately by changing the registration data provided to FLORA.

Suspicious e-mails. FLORA may send e-mails with publicity messages, advertising products and services or updating information. FLORA does not send messages (i) requesting the User’s password or financial data; (ii) with attached files other than PDF documents; or (iii) with links to download files. If you receive an e-mail with these characteristics, disregard it.

Credit Cards. FLORA does not store Users’ financial information, such as credit card information, in its database. The payment approval procedure takes place between the User, banks and card companies, without FLORA’s intervention.

8. What are your rights?

It warrants emphasis that you will always have rights regarding the privacy and protection of your data, and FLORA, in addition to being concerned about the security of this data, also ensures that you have access and are aware of all your rights. Therefore, we summarize all the rights you have below, with a brief explanation of each:

Confirmation. Allows you to request confirmation of the processing we are performing on your personal data and/or any other information that is important to you.

Access to data. Allows you to access the personal data we hold about you and to get information about how your personal data is being used.

Correction. Allows you to request correction of inaccurate, incomplete or outdated personal data that we keep about you. However, in order to make this correction, we will have to check the validity of the data you provide.

Elimination. This allows you to ask us to anonymize, block or delete unnecessary, excessive or non-compliant data, always taking exceptions into consideration regarding the maintenance of data by FLORA as required for legal compliance purposes.

Data portability to another service provider or product supplier. Allows you to request the electronic transfer, copy or transmission of the personal data you have provided to us to third parties under certain circumstances.

Information about sharing. Allows you to request information about the eventual sharing of your data with public and private entities.

Information about Non-consent and Revoking Consent. Allows you to withdraw consent to the processing of your personal data (to the extent that such processing is based on consent) and/or be informed of the consequences of denial.

Complaint to National Authority. Allows you to lodge a complaint with the Data Protection Authority about the way we handle your personal data.

Opposition to processing. Allows you to challenge where and in what context we are processing your personal data for different purposes. However, we may demonstrate that we have legitimate reasons for processing your data, which may override your reasons if, for example, they are essential to the provision of our Service.

9. Party Responsible for Protecting your Personal Data

The party responsible for the database in Brazil is FLORA PRODUTOS DE HIGIENE E LIMPEZA S.A. (“FLORA”), duly enrolled in the National Corporate Taxpayer Registry (CNPJ) under no. 08.505.736/0001-23, located at Avenida Marginal Direita do Tietê, 500, Vila Jaguará, São Paulo, Brazil. 10. Changes to the Privacy Terms

We may modify or change these Privacy Terms from time to time. To indicate when we make changes to these Privacy Terms, we will change the revision date at the top of this page. The new modified Terms will be applicable as of this revision date. Therefore, we encourage you to periodically review these Terms to remain informed about how we are protecting your information. When providing information through this website, you agree to the information described above.

We also note that, in addition to these Privacy Terms, there may be specific campaigns or promotions that will be governed by additional privacy terms or policies. We encourage you to read these additional terms or notices before participating in such campaigns or promotions as you will be required to comply with them if you wish to participate. Any additional privacy terms or policies will be highlighted for you.
